End User License Agreement

Effective 17 October 2026 · Version 2026-10-17

Not legal advice. This EULA is a licence for the compiled SpeakGlide mobile app distributed through the Apple App Store and Google Play. It is not personalised legal advice.
Changes.
  • Version 2026-10-17 (17 October 2026): A SpeakGlide account (Google or Apple sign-in) is now required to use the apps; guest use without an account is no longer offered. Free trial extended from 7 to 14 days of Pro for every new account. Terms: in the desktop apps from this website the trial starts when you create your account, needs no payment details and ends on its own (one per account and per Google or Apple sign-in); in the iOS and Android apps it is the App Store / Google Play free trial of Pro monthly, which renews unless cancelled before it ends. Privacy Policy: the server stores the trial dates and a keyed hash of the Google or Apple identifier that used it (kept 3 years, also after account deletion) to prevent repeat trials. The EULA text is unchanged.
  • Version 2026-10-15c (15 October 2026): Website purchases are now sold through Link, LLC (Stripe Managed Payments) as reseller and merchant of record: Link/Stripe handle payment, VAT/sales tax, receipts, refunds (including within 60 days), disputes and transaction support; statement descriptor LINK.COM*; prices include VAT where applicable. Privacy Policy updated for Link/Stripe as independent controllers. App Store and Google Play purchases are unchanged.
  • Version 2026-10-15b (15 October 2026): Clarified warranty disclaimer (as is / as available), accuracy of automated output and unsuitable uses, availability, third-party services, liability limits (cap: fees paid in the prior 12 months, or CHF 50), indemnity and consent for recordings, force majeure, governing law and consumer protections, class action waiver where lawful, and severability; Privacy Policy: security limits and user-entered content. Mandatory consumer and data-protection rights are unchanged.
  • Version 2026-10-15 (15 October 2026): Product renamed from Werbatim to SpeakGlide, no change to data processing. Website, domain and contact email are now speakglide.com and info@speakglide.com.
  • Version 2026-10-13 (13 October 2026): Previous version.

1. Parties

This EULA is between you and:

Stefano Cossi
Private individual
Email: info@speakglide.com

The Licensor’s postal address for legal identification is stated in the Terms of Use (provider identity) and is not repeated here.

2. Application identifiers

Identifiers documented in this website repository and related product copy:

  • iOS: com.speakglide.app
  • Android Play package: com.speakglide.app (googlePlayPackageName())

3. Acceptance

By installing or using the App you agree to this EULA, the Terms of Use, and the Privacy Policy. If you do not agree, do not install the App. Creating an account additionally requires that you explicitly accept this EULA, the Terms of Use and the Privacy Policy (one box each) and confirm that you are at least 16 years old, and accept any new version of them before you continue to use the account. You must be 16 or older to create an account or buy a plan; if you are under the age of majority where you live, a parent or legal guardian must agree to this EULA on your behalf.

4. Licence grant

4.1 Store binary

The Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App as distributed through the Apple App Store or Google Play on devices you own or control.

4.2 Source code

If source is published separately, the licence file in that repository governs the source. That licence does not grant trademark rights in the SpeakGlide name, logo, or store listing, and does not grant access to any backend the Licensor may later operate.

4.3 Branding

If you publish a derivative from source, you must not present it as official SpeakGlide or reuse the SpeakGlide marks without permission.

5. Restrictions (store binary)

  • Do not redistribute the store binary
  • Do not remove proprietary notices in the App
  • Do not use the App in violation of law

6. Third-party components named on this site

NVIDIA Parakeet TDT 0.6B v3
ONNX export by Igor Stupakov
Licence: CC-BY-4.0

Bundled speech model. Product copy states it runs on-device.

Helsinki-NLP OPUS-MT
ONNX exports by Xenova / Hugging Face
Licence: Apache License 2.0

Translation models described as downloaded on demand and run on-device.

7. Your content

You retain ownership of recordings and transcripts. The marketing site states this content stays on the device unless you export it. You are responsible for legality, consents, backups, and sharing. You must inform and obtain the consent of every person you record where applicable law requires it, and you must keep your own backups: the App stores content locally and the Licensor cannot restore lost content.

Your custom Dictionary is also your content. It is processed on the device; it is stored on the operator’s server only while you are signed in, solely to sync it between your devices, encrypted at application level. You can export or delete it at any time, and it is deleted with your account. Audio always stays on the device.

8. Purchases and entitlements

Paid features may be sold through the Apple App Store, Google Play, or Stripe-hosted Checkout on the Licensor’s website, where Link, LLC (a Stripe company) sells the purchase to you as reseller and merchant of record and handles payment, tax, receipts and transaction support; this EULA still governs your licence to the App. The website exposes GET /api/me/subscription so the app can read the highest active plan. Store receipts are not yet verified on this site (App Store Server Notifications v2 and Play RTDN are planned). Desktop builds advertised on /pricing are not distributed from this website.

9. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP, ITS MODELS AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement, and any warranty of uninterrupted or error-free operation. No uptime or availability of sign-in, entitlement or model-download services is guaranteed.

Transcripts, translations and other output are generated automatically and may be inaccurate or incomplete. You must verify output before relying on it. The App is not designed or intended for medical, legal, financial, safety-critical or emergency use, or for any situation where errors could cause death, personal injury or significant damage. You use the App and its output at your own risk. The Licensor is not responsible for the App Store, Google Play, Stripe, your operating system, device, other apps or other third-party services.

Mandatory rights. Nothing in this EULA excludes or limits (a) liability for intent (wilful misconduct) or gross negligence, (b) liability for death or personal injury, (c) liability for fraud, (d) liability under mandatory product-liability law, (e) your statutory rights as a consumer, including the legal guarantee of conformity for digital content and digital services under the law of your EU/EEA or UK country of residence, or (f) any other liability or right that cannot be excluded or limited under applicable law. Where such law applies, the limitations in this EULA apply only as far as it allows.

10. Liability

Subject to the mandatory rights in section 9 and to the maximum extent permitted by applicable law:

  • No liability for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, goodwill or opportunity
  • No liability for loss or corruption of recordings, transcripts, dictionary entries or other data; you are responsible for backups
  • No liability for inaccurate output, interruptions, or third-party services, operating systems, devices or stores
  • Liability for slight negligence is excluded where the law allows; otherwise it is limited to typical, foreseeable damage
  • Total aggregate liability is capped at the fees you actually paid for the App or subscriptions in the twelve (12) months before the event giving rise to the claim or, if you paid nothing in that period, CHF 50

11. Indemnity

To the maximum extent permitted by applicable law, you indemnify and hold harmless the Licensor against third-party claims, losses, fines, costs and reasonable legal fees arising from your use or misuse of the App, your content, recordings made without legally required consent or notice, or your breach of this EULA or of law. For consumers, this applies only to the extent you are at fault and as permitted by mandatory law.

12. Termination

Uninstall the App to stop using it. The Licensor may terminate this EULA if you breach it. Source-code rights, if any, follow the repository licence. Your local files remain until you delete them.

13. Export and store terms

You must follow applicable export laws. If you downloaded the App from the Apple App Store, this EULA is between you and the Licensor, not Apple; Apple is a third-party beneficiary entitled to enforce it. Google Play downloads are also subject to the Google Play Terms of Service.

14. Governing law

Swiss substantive law, excluding conflict-of-laws rules and the CISG. Exclusive jurisdiction lies with the courts at the Licensor’s seat in Neuchâtel, Switzerland. Consumers keep the protection of the mandatory law of their country of habitual residence and the consumer forums that mandatory law provides. Where permitted by law, claims may be brought only individually and not in a class, collective or representative action; this does not limit representative actions available under mandatory consumer law.

15. General

This EULA, the Terms of Use, and the Privacy Policy are the entire agreement for the App. The Licensor is not liable for failures or delays caused by events beyond its reasonable control (force majeure), without affecting mandatory consumer rights. If any provision is invalid or unenforceable, it is limited or replaced by the valid provision closest to its intent (for consumers, by the statutory rule) and the rest remains in force.
